Terms and Conditions for booking with and staying at Black Isle Yurts ("Terms")
It is our aim to make your stay in our Yurts a wonderful experience. These Terms enable us to maintain standards, ensure your safety and establish a clear legal contract for booking, cancellation, damage and exceptional circumstances. By making a booking with us, you signal your acceptance of these Terms.
Black Isle Yurts is a limited company and the registered business address is Ruadh-Ard, Charleston, North Kessock, Inverness, IV1 3YA
There is a minimum stay of 2 nights.
Included in the rental price of every Yurt is:
rental of the Yurt and pitch
a basketful of firewood for your wood-burning stove
use of and access to Black Isle Yurts grounds and facilities, where permitted; and reasonable use of water
The maximum capacity of each Yurt (5, 4, 3 or 2 adults, depending on the Yurt) should not be exceeded.
Extra wood is available at £5 per basket.
When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by email. We will endeavour to provide this confirmation in a timely manner but sometimes it may take several days if it coincides with winter holidays / annual leave.
We permit a reasonable number of day visitors during your Black Isle Yurts stay. These visitors will need to check-in with us.
We may refuse group bookings of more than 1 Yurt, if we feel that accepting them may be of detriment to other guests staying. Please appreciate this is a quiet site and we try to retain and promote the peace and tranquillity of this place for our Guests, particularly after 10 pm. Also, all communal areas need to be kept clear and clean for the enjoyment of all Guests.
We may refuse entry to any group bookings not authorized at the time of booking and any monies paid will not be reimbursed. For questions regarding groups, please email or phone us.
Booking and Payment
We only accept bookings from persons over the age of 18.
Bookings for arrivals within the next 6 weeks can only be secured by payment in full.
Bookings for arrivals beyond the next six weeks can be secured by a 30% deposit, provided that the 70% balance is paid at least 6 weeks in advance of the arrival date. Any failure by you to pay the balance on time will entitle us to treat your booking as cancelled by you, and follow our procedure for cancellations.
We accept payment exclusively through our online booking system (if there is a genuine difficulty in using the online system please call or email us to find an alternative payment solution).
Changes to Your Booking
If, after confirmation of the booking, you would like to make some change to the booking, although we will always do our best, we are not obliged to satisfy these requests. Whether and to what extent these alterations will be accommodated is at our discretion.
If you have to cancel, please let us know immediately and we will try to resell your holiday.
If we are able to resell every yurt night in your booking, we will refund to you all monies already paid, less a £25 administration fee.
If we are unable to resell every Yurt night in your booking, but you let us know 6 weeks or more ahead of your arrival date, you will forfeit the deposit paid and you will not be liable to us for the balance.
If we are unable to resell every yurt night in your booking, and you let us know less than 6 weeks before your arrival date, you will be liable for the full cost of your holiday less the value of any yurt nights we were able to resell.
Any refunds due to you following cancellation will be processed shortly after the end of the month in which the holiday is resold.
Please consider whether cancellation insurance may be appropriate for you.
Your Yurt is available from 4 pm on the day of arrival, though you may come earlier to enjoy the grounds during the day.
Please park in the parking area, because vehicles are not permitted all the way down to the facilities building (the Hub).
When you arrive, please check-in at the Hub. If you are unable to arrive before 8pm, please email us or phone us on 01381 620634 so that we can give you the appropriate arrival information.
Please leave your Yurt before 11 am and leave everything in a clean and tidy condition.
On departure, please check the Yurt keys in with us. Any lost or unreturned keys will be charged at £15 replacement cost.
If the Yurt or associated equipment is left in an improper or damaged condition, you will be responsible for reasonable additional cleaning and/or replacement costs.
Lost property will be returned by post at your expense by request only. Any unclaimed property left behind will be kept until the end of the season and then disposed of.
We encourage you to talk to us if you have a complaint during the course of your stay, so that we can try to resolve it as soon as possible. We will always try to rectify any issues that arise to the satisfaction of our customers.
Privacy and Data Protection
By contracting with us you consent that we may process any personal data that you provide to us for the purpose of facilitating your stay. We have a strict policy of not transferring any personal data to any third party organizations who would use such data for marketing purposes.
Limitation of Liability
The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy.
We hereby expressly exclude:
All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and
Any liability for any indirect or consequential loss or damage incurred by any user of this website, any person who makes a booking or any person who stays with us at Black Isle Yurts whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
We shall not be liable to you as a result of any delay or failure to perform our obligations under the Terms as a result of any act, event or accident (a Force Majeure Event).
A Force Majeure Event includes but is not limited to industrial disputes, failure of a utility service or transport network, an act of God, civil commotion or malicious damage, compliance with any law or governmental order, rule, regulation or direction, the accident breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.
No failure or delay by a party in exercising any right or remedy under the Terms or by law shall constitute a waiver of that or any other right or remedy, nor preclude or restrict its further exercise of that or any other right.
If a court or any other competent authority finds that any provision of these Terms (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the other provisions of the Terms shall not be affected.
A person who has not made a booking with us under these Terms shall not have any rights under or in connection with them.
Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them, the subject matter or formation of them (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, Scots law, and the parties submit to the exclusive jurisdiction of the courts of Scotland.
Code of Conduct
Black Isle Yurts are sure you will have a memorable holiday with us, but please take note of the following code to be observed for the safety and comfort of all visitors
No smoking in the yurts, and if smoking outside, dispose of cigarette butts in the appropriate waste bin, making sure there is no fire risk
As the yurts are shoe free zones, please always remove outdoor footwear before entering your yurt.
Please be responsible for your children's safety at all times.
Take care especially around livestock and farm machinery – Black Isle Yurts is part of a working farm.
It is a condition of your booking that the total number of your party does not exceed the total allowed persons per yurt.
Sound travels a long distance in the countryside so please appreciate that this is a quiet site and try to retain and promote the peace and tranquillity of this place for other Guests, particularly after 10 pm.
Please behave responsibly and keep fires small and manageable in the stoves. Only use ‘tea-light’ candles in safety holders if you want candle light in your yurt. If there is a high fire risk because of particularly dry conditions, management reserves the right to ban communal fires.
In consideration of the other Guests, please leave the public areas in a clean and clear condition. Valuables should be kept either in guests’ car (if they have one), or in their Yurt.
You are expected to wash, dry and return dishes, cutlery, etc, to their original storage place and put your waste into one of the appropriate waste bins prior to your departure.
